TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the websites, mobile apps, text message alert services, forecasts, radar, maps, articles, videos, reporting tools, accounts, subscriptions, and other services operated by Instant Weather Inc. ("Instant Weather," "we," "our," or "us") (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, do not use the Services.


Use of the Services

You may use the Services only in compliance with these Terms and applicable law.

You agree not to:

  • use the Services for any unlawful, fraudulent, abusive, harmful, or misleading purpose;

  • interfere with the operation, security, or proper functioning of the Services;

  • attempt to gain unauthorized access to accounts, systems, or data;

  • upload malware, malicious code, or other harmful material;

  • submit false, fraudulent, or intentionally misleading weather reports or other content;

  • impersonate another person or misrepresent your identity or affiliation;

  • violate the rights of Instant Weather or any third party; or

  • use the Services in a way that could damage, disable, overburden, or impair the Services.


Accounts and Access

Some features of the Services may require an account, login, or paid subscription.

You are responsible for:

  • providing accurate account information;

  • maintaining the confidentiality of your login credentials;

  • all activity that occurs under your account; and

  • notifying us promptly if you believe your account has been used without authorization.

We may suspend or terminate access to an account or feature if we reasonably believe these Terms have been violated or if doing so is necessary to protect the Services, users, or the public.


Content and Intellectual Property

Unless otherwise stated, the Services and their content, including text, graphics, branding, layouts, forecasts, maps, radar displays, articles, videos, software, logos, and compilations, are owned by Instant Weather or our licensors and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use.

Except as permitted by law or with our written permission, you may not:

  • reproduce, republish, distribute, sell, license, or commercially exploit our content;

  • copy substantial portions of our content for commercial purposes;

  • remove copyright, trademark, or proprietary notices; or

  • use our trademarks, logos, branding, or presentation without written permission.


Automated Access, Scraping, and AI Training

You may not use robots, bots, spiders, scrapers, crawlers, automated tools, or similar technologies to access, extract, copy, monitor, or collect content or data from the Services without our prior written permission.

You may not use content from the Services to develop, train, test, or improve machine learning models, artificial intelligence systems, large language models, or similar technologies without our prior written permission.


Forecasts, Alerts, and Informational Content

The Services are provided for general informational purposes only. Weather is inherently uncertain, and forecasts, maps, radar interpretations, alerts, reports, articles, and related content may change quickly.

While we strive to provide timely and useful information, we do not guarantee that any forecast, alert, report, map, article, or other content will always be accurate, complete, current, available, or suitable for your specific situation.

You are responsible for your own safety decisions and actions. In emergencies, always follow instructions from emergency services, public authorities, and official alerting systems.


User Submissions

The Services may allow you to submit weather reports, storm reports, damage reports, photos, videos, comments, messages, or other content ("Submissions").

You represent and warrant that:

  • you own the Submission or have all rights necessary to provide it to us;

  • the Submission does not infringe any third-party rights, including copyright, privacy, publicity, or other legal rights;

  • the Submission is not knowingly false, misleading, unlawful, defamatory, obscene, or harmful; and

  • you have obtained any permissions needed from any identifiable person in the Submission, where required.


Ownership of Your Submissions

You keep ownership of the content you submit.

However, by submitting content to Instant Weather, you grant Instant Weather a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable licence to host, store, reproduce, adapt, format, modify for presentation, publish, display, perform, distribute, transmit, excerpt, archive, and otherwise use your Submission, in whole or in part, in connection with:

  • operating, improving, and promoting the Services;

  • weather coverage and public safety communications;

  • community awareness and educational content;

  • publication on our website, apps, and social media channels;

  • sharing with research and verification partners, including the Canadian Severe Storms Laboratory (CSSL), the Northern Tornadoes Project, and the Northern Hail Project;

  • internal review, verification, documentation, archive, and promotional uses related to Instant Weather’s mission and Services; and

  • sharing with news outlets, media organizations, emergency partners, or public information channels where relevant to weather coverage or public awareness.

This licence allows us to use your Submission without further notice to you and without compensation unless we separately agree otherwise in writing.


Public Nature of Submitted Content

If you submit weather reports, photos, videos, or similar materials to us, you understand that they may be displayed, reposted, published, discussed, or shared publicly through our Services and related channels as part of weather coverage, public awareness, verification, or research activities.

If you do not want content to be shared publicly or with research partners, do not submit it to us.


Moderation and Removal

We may, but are not required to, review, moderate, reject, remove, edit, or refuse to publish any Submission or other content at our discretion, including where we believe it may:

  • violate these Terms;

  • create legal risk;

  • be misleading, false, abusive, or unsafe;

  • infringe someone else’s rights; or

  • be inconsistent with the purpose of the Services.


Third-Party Services and Links

The Services may include links to or integrations with third-party services, including payment processors, app stores, login providers, social media platforms, analytics providers, advertising services, and communication providers.

We do not control third-party services and are not responsible for their content, availability, policies, or practices. Your use of those services may be subject to their own terms and policies.


Paid Services and Subscriptions

Some parts of the Services may require payment, including premium app features, text message alert subscriptions, or other paid services.

If you purchase a subscription:

  • pricing, billing cycle, and included features will be described at the time of purchase;

  • app-based subscriptions may be billed and managed through Apple or Google, subject to the terms of those platforms;

  • other subscriptions may be billed through providers such as Stripe or PayPal;

  • subscriptions may renew automatically unless cancelled before renewal, where applicable and as disclosed at purchase; and

  • we may change pricing or features for future billing periods, subject to applicable law.

Text message alert subscriptions are separate from app subscriptions unless we expressly state otherwise.

Unless required by law or expressly stated otherwise, fees are non-refundable once charged.


Text Message Alerts

If you subscribe to text message alerts, you agree that:

  • we may send you weather alert messages to the mobile number you provide;

  • message frequency may vary depending on weather conditions and alert activity;

  • delivery may be affected by your mobile carrier, device, service availability, and other factors outside our control;

  • message and data rates may apply depending on your mobile plan;

  • you are responsible for providing and maintaining an accurate mobile number; and

  • you may opt out using the method provided in the messages or by contacting us.

Text message alerts are intended as a supplemental notification service and are not guaranteed to be timely, complete, or available at all times.


Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis.

Instant Weather disclaims all representations, warranties, and conditions, whether express, implied, or statutory, including implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

  • the Services will be uninterrupted, secure, error-free, or always available;

  • defects will be corrected;

  • the Services or servers will be free of viruses or other harmful components; or

  • any content will always be accurate, complete, timely, reliable, or suitable for your needs.


Limitation of Liability

To the fullest extent permitted by law, Instant Weather and its directors, officers, employees, contractors, affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings, arising out of or related to your use of, or inability to use, the Services.

To the fullest extent permitted by law, Instant Weather’s total liability for any claim arising out of or relating to the Services will not exceed the greater of:

  • the amount you paid us for the specific paid service giving rise to the claim in the 12 months before the claim; or

  • CAD $100.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.


Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless Instant Weather and its directors, officers, employees, contractors, affiliates, licensors, service providers, and partners from and against claims, losses, liabilities, damages, judgments, awards, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your use or misuse of the Services;

  • your Submissions;

  • your violation of these Terms; or

  • your violation of any law or third-party right.


Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and disclose personal information.


Suspension, Termination, and Service Changes

We may modify, suspend, limit, or discontinue any part of the Services at any time, with or without notice.

We may suspend or terminate your access to all or part of the Services if we reasonably believe you have violated these Terms, created risk for us or others, or where necessary for operational, legal, safety, or security reasons.


Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict of laws principles.

You agree that disputes arising out of or relating to these Terms or the Services will be brought in the courts located in Ontario, Canada, unless applicable law requires otherwise.


Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version and revise the effective date.

Your continued use of the Services after updated Terms take effect means you accept the revised Terms, to the extent permitted by law.
